§ 1 Scope

1.1 These General Terms and Conditions (“Terms”) apply to all coaching services provided by Lea Skapetze, trading as The Final Piece (“Coach”), to the client (“Client”).

1.2 These Terms apply in the version valid at the time the contract is concluded. Deviating terms of the Client do not apply unless expressly agreed in writing.

§ 2 Subject of the contract

2.1 The Coach provides life and mental coaching in the field of emotional independence and attachment.

2.2 The service comprises individual 1:1 online coaching.

2.3 The Coach owes a service (Dienstleistung, §§ 611 ff. BGB), not a specific result. No particular outcome, improvement, or success is warranted.

2.4 The nature and limits of the service are further defined in § 8 below, which forms an integral part of these Terms.

§ 3 Formation of the contract

3.1 The contract is concluded when the Client submits a booking and the Coach confirms it in text form.

3.2 By submitting the booking, the Client confirms having received and accepted these Terms, the withdrawal instruction, and the Privacy Policy prior to the conclusion of the contract.

3.3 The Client confirms they are at least 18 years old.

§ 4 Term, package and termination

4.1 The contract begins on the start date confirmed by the Coach in text form (“Start Date”), usually the date of onboarding. Service periods follow the calendar month: the first service period runs from the Start Date to the end of that calendar month; each subsequent service period is one full calendar month.

4.2 The minimum term ends at the end of the calendar month in which three (3) months have passed since the Start Date. After the minimum term has expired, the contract continues for an indefinite period and renews automatically from calendar month to calendar month.

4.3 At booking, the Client chooses one of the following packages: weekly 1:1 sessions or biweekly 1:1 sessions (every two weeks). The chosen package is the running package. It remains in effect, and the contract is renewed with that same package for each following calendar month, unless the Client requests a change in accordance with 4.4.

4.4 The Client may switch between the weekly and the biweekly package with effect from the beginning of the next calendar month. The request must be made in text form (email is sufficient) no later than 14 days before the end of the current calendar month. If no such request is received in time, the contract is renewed for the next calendar month with the current package; a later request takes effect from the beginning of the calendar month after next.

4.5 After the minimum term has expired, either party may terminate with 14 days notice to the end of a calendar month, in text form (email is sufficient). Notice may already be given during the minimum term, with effect from the end of the minimum term at the earliest.

4.6 The right to extraordinary termination for good cause (§ 626 BGB) remains unaffected. This includes the circumstances described in § 8.4.

§ 5 Right of withdrawal (consumers)

5.1 If the Client is a consumer within the meaning of § 13 BGB, they have a statutory right to withdraw from this contract within 14 days without giving any reason.

5.2 The withdrawal instruction and the model withdrawal form are provided as a separate document, which was made available to the Client in text form prior to the conclusion of the contract and forms an integral part of these Terms.

5.3 The right of withdrawal expires prematurely if the Coach has fully performed the service and only began performance after the Client expressly requested this and simultaneously confirmed their knowledge that they would lose the right of withdrawal upon complete performance (§ 356 (4) BGB).

5.4 If the Client requested that performance begin during the withdrawal period and then withdraws, the Client owes a proportionate amount for the services already provided (§ 357 (8) BGB).

§ 6 Fees and payment

6.1 The monthly fee depends on the running package under § 4.3 and § 4.4: 600.00 € for weekly 1:1 sessions, 400.00 € for biweekly 1:1 sessions (every two weeks). The Coach applies the small-business regulation under § 19 UStG; no VAT is charged.

6.2 Fees are invoiced monthly in advance. Invoices are issued on the 1st day of each calendar month and cover the calendar month ahead.

6.3 The first invoice is issued on the 1st day of the calendar month following the Start Date. It covers (a) the first service period from the Start Date to the end of the previous calendar month, charged pro rata per calendar day of the monthly fee, and (b) the fee for the calendar month ahead. Example: Start Date 20 October, weekly package – the invoice issued on 1 November covers 20–31 October (12/31 × 600.00 € = 232.26 €) and November (600.00 €), a total of 832.26 €. If the Start Date is the 1st day of a month, the first invoice is issued on the Start Date and covers that calendar month only.

6.4 Invoices are due within 14 days of the invoice date without deduction.

6.5 In the event of late payment, statutory default provisions apply. The Coach may suspend services while payment is outstanding.

6.6 Sessions cancelled by the Client less than 24 hours in advance are deemed to have taken place, unless the Client is prevented for reasons beyond their control.

§ 7 Client’s obligations

7.1 Coaching requires the Client’s active participation. The Client remains responsible for the decisions they make and the actions they take.

7.2 Before starting, the Client shall inform the Coach if they are currently receiving psychotherapeutic or psychiatric treatment, or have done so within the last 24 months.

§ 8 Important note: these services are not a substitute for professional help

8.1 The content on the-final-piece.com and the courses offered are intended solely for personal development and information. They do not constitute medical, psychological, or therapeutic advice or treatment. Coaching is a non-medical service and is not a curative treatment (Heilbehandlung) within the meaning of the Heilpraktikergesetz.

8.2 I, Lea Skapetze, do not act as a psychologist, psychotherapist, or physician within this coaching, and no physician-patient or therapist-client relationship arises. I share my own experiences and insights.

8.3 If you suffer from mental health conditions such as depression, anxiety disorders, or other serious psychological distress, I strongly recommend that you seek professional medical or psychotherapeutic help. Please contact a qualified professional or an appropriate support organisation.

8.4 Where such a condition is present or suspected, I may terminate the coaching relationship extraordinarily and will, where indicated, refer you to appropriate care.

§ 9 Confidentiality

9.1 Both parties treat all information disclosed during the coaching as confidential and do not share it with third parties.

9.2 This obligation survives the end of the contract.

9.3 The Coach is not subject to a statutory right to refuse testimony (Zeugnisverweigerungsrecht) and points this out expressly.

§ 10 Liability

10.1 The Coach is liable without limitation for injury to life, body, or health, and for intent and gross negligence.

10.2 For slight negligence, the Coach is liable only for breach of a material contractual obligation, and limited to the foreseeable damage typical for this type of contract.

10.3 Any further liability is excluded.

§ 11 Intellectual property

11.1 All programme materials, worksheets, recordings, and methods remain the intellectual property of the Coach.

11.2 They are provided for the Client’s personal use only and may not be copied, shared, published, or used commercially without prior written consent.

11.3 Recording of sessions by the Client requires the Coach’s prior consent.

§ 12 Data protection

Personal data is processed in accordance with the GDPR and the Privacy Policy at www.the-final-piece.com/legal.

§ 13 Final provisions

13.1 German law applies. For consumers habitually resident in another EU member state, the mandatory consumer protection provisions of that state remain unaffected.

13.2 Amendments and supplements require text form.

13.3 Should any provision be or become invalid, the validity of the remaining provisions is unaffected.

13.4 The Coach is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

13.5 These Terms are provided in English for the Client’s convenience. The German version of the withdrawal instruction and the model withdrawal form is authoritative; in the event of any discrepancy, the German version prevails.

ANNEX: WITHDRAWAL INSTRUCTION AND MODEL WITHDRAWAL FORM (§ 5.2)

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform me —

— by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the model withdrawal form below, but this is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, I shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which I am informed about your decision to withdraw from this contract. I will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested that the provision of services begin during the withdrawal period, you shall pay me an amount which is in proportion to what has been provided until you have communicated to me your withdrawal from this contract, in comparison with the full coverage of the contract.
